Terms of service

The terms governing your use of the Hadeda app, portal and services.

Introduction

These Terms of Service (the "Terms") govern your access to and use of the services provided by Hadeda Pay (Pty) Ltd ("Hadeda", "we", "us"): the Hadeda mobile application, the Hadeda manager portal, the associated metering infrastructure and the in-app payment facility (together, the "Services"). By creating an account or using the Services you agree to these Terms. If you do not agree, please do not use the Services.

Who can use the Services

Accounts are created either by you, or on your behalf by your landlord, property manager or body corporate. You must provide accurate information and are responsible for keeping your login details secure and for all activity under your account. You must be legally able to enter into these Terms in your jurisdiction.

The Services

Hadeda measures utility consumption at your address using smart meters (currently water, with electricity and gas rolling out), presents your usage, bills and alerts, and lets you settle amounts owing through an in-app payment facility. Consumption data and bills are shared with the landlord, property manager or body corporate responsible for the property for billing purposes. Features described as "rolling out" are not yet generally available and may change before release.

Billing and payments

Bills are generated from meter readings and the tariffs configured by the party responsible for your property; the tariffs, charges and due dates are set by that party, not by Hadeda. In-app payments are processed by our third-party payment service provider, and by making a payment you also agree to that provider's terms. You are responsible for settling amounts owing by their due dates. We are not a party to the underlying tenancy, lease or supply agreement between you and your property, and disputes about the amounts charged should be raised with that party.

Acceptable use

You agree not to misuse the Services, including attempting to gain unauthorised access, interfering with the meters or platform, reverse engineering the software, or using the Services unlawfully or to infringe the rights of others. We may suspend or terminate access that breaches these Terms or that we reasonably believe poses a risk to the Services or other users.

Availability

We work to keep the Services available and accurate, but they are provided on an "as is" and "as available" basis. Meter transmissions, connectivity and third-party systems can be interrupted, and readings or estimates may occasionally be delayed or corrected. We do not warrant uninterrupted or error-free operation.

Liability

To the maximum extent permitted by law, Hadeda is not liable for indirect or consequential loss arising from your use of the Services. Nothing in these Terms limits any liability that cannot lawfully be limited, including your rights under the Consumer Protection Act where it applies.

Privacy

Our handling of personal information is described in our Privacy policy, which forms part of these Terms.

Changes to these Terms

We may update these Terms from time to time. Where changes are material we will take reasonable steps to notify you, and continued use of the Services after an update means you accept the revised Terms.

Governing law

These Terms are governed by the laws of the Republic of South Africa.
